"Behavioural sciences help refine our understanding of human decision-making. Their insights are immensely relevant for policy-making since public intervention works much better when it targets real people rather than imaginary beings assumed to be perfectly rational. Increasingly, governments around the world are keen to rely on those insights for reshaping public interventions in a wide range of policy areas such as energy, health, financial services and data protection. When policy-making meets behavioural sciences, effective and low-cost regulations can emerge in the form of default rules, smart disclosure and simplification requirements. While behaviourally-informed intervention has a huge potential for policymaking, it also attracts legitimacy and practicability concerns. Nudge and the Law takes a European perspective on those issues and explores the legal implications of the emergent phenomenon of behavioural regulation by focusing on the challenges and opportunities it may offer to EU policy-making and beyond."

Following the French and Dutch rejection of the draft constitutional Treaty, many questions have arisen about the European Union's political model, its social model, its geographical borders and limits, its founding principles and its identity. Is Europe in deep crisis, or is crisis its usual way of operating? Does enlargement consign the project of the founding fathers to history, or does it force today's political leaders to go back to basics? There is no lack of questions and controversies. In a sense, this proves that the EU has now gone beyond technical issues and is becoming a fundamentally political entity. Too soon or too late, some will say, but the debate is now underway.

The contributors to this edition of Social Developments in the European Union examine the European social model, from both the inside and the outside, the governance of the euro zone, the political priorities outlined in the financial perspectives for 2007-2013, and recent and forthcoming enlargements. They also highlight the important role of political, economic and social stakeholders in debate around the "better legislation" initiative, the Lisbon strategy, European social dialogue and the issue of pensions. The forum for debate plainly acquired a strong European dimension in 2005. Perhaps the way out of the present crisis might therefore be to devise a coherent new project and promote the emergence of political players who are prepared to implement it.

The first is the results of the Lisbon Summit held in March and, in particular, its impact on the European employment strategy. Secondly, the report could hardly omit to offer a detailed analysis of the Social Agenda adopted at the Nice European Summit in December and which defines – for the period until at least 2003, when it may be revised – the European Union's social policy priorities. The third development relates to social security concerns, with special reference to the fight against social exclusion and poverty on the one hand and the future of retirement pensions on the other. The last area of focus is the enlargement of the EU to the countries of central and eastern Europe, a development which is giving rise to an increasing number of questions, particularly as regards its social implications. The analysis and evaluation of these four important areas of concern offers insight into the rationales and dynamics currently at work in the European institutions in the social policy field.

"This volume is the 20th anniversary edition of Social policy in the EU: state of play. Coordinated by Cécile Barbier and Philippe Pochet, the first edition covered the year 1999 and was published as a collaborative project between the European Social Observatory (OSE) and the European Trade Union Institute (ETUI) in 2000.
This anniversary edition looks back at the main developments in EU social policymaking over the past two decades. Key questions addressed in this volume include:
what was the place of the social dimension during the financial and economic crisis?
Who has driven, and who has braked, EU social policymaking?
Which instruments does the EU have at its disposal for ‘market correcting' policies?
And last but not least, what are the next steps in the further implementation of the EU's social dimension, especially in the context of the European Pillar of Social Rights?
The editors provide also an analytical chronology of the main developments of the EU's social dimension over the past twenty years and summarise the key messages put across by the authors of the book's chapters regarding key EU social policy areas. The chapter also discusses some of the recent debates on the EU's social agenda under the new von der Leyen European Commission, while providing policy recommendations drawing on the analyses presented in this book.
Despite many optimistic statements by the EU leaders, social policy remains a ‘nice to have' (if and when the economic and political context allows for it), not a ‘must have'."

Coordonnée par Cécile Barbier et Philippe Pochet, la première édition couvrait l'année 1999 et a été publiée en 2000 dans le cadre d'un projet de collaboration entre l'Observatoire social européen (OSE) et l'Institut syndical européen (ETUI).

Cette édition anniversaire revient sur les principales évolutions de la politique sociale de l'UE au cours des deux dernières décennies. Parmi les questions clés abordées dans ce volume, citons les suivantes :

Quelle a été la place de la dimension sociale au cours de la crise financière et économique ?
Qui a conduit et qui a freiné l'élaboration des politiques sociales de l'UE ?
De quels instruments l'UE dispose-t-elle pour les politiques de « correction du marché » ?
Enfin, quelles sont les prochaines étapes de la mise en oeuvre de la dimension sociale de l'UE, en particulier dans le contexte du socle européen des droits sociaux ?
