"Transnational collective bargaining (TCB) has become a ‘hot' topic of European industrial relations. As well as collective bargaining between workers and employers conducted at the sectoral or national level, negotiations on employee rights and working conditions now also take place at the supranational level, within multinational companies. It is a development that poses major challenges for trade unions, as well as for employers and lawmakers. This book takes stock of the particular challenges faced by trade union representatives, works councils and employer organisations; it reviews the existing literature on this topic and examines contrasting views of the prospects for subsequent development of this new practice; it also offers some practical suggestions for policymakers who find themselves having to deal with this new component of the Europeanisation of industrial relations.
One of the key questions tackled in the book is whether a regulatory framework for TCB is feasible, necessary and/or useful. Perhaps even more importantly: can we, given the proliferation of instances of TCB, actually manage without such a legal system, and what should be the main elements of such a framework? By providing a better understanding and a critical analysis of the emergence and development of transnational collective bargaining, the authors of this book offer valuable help to trade unionists and practitioners in preparing for – and being prepared for – this next stage in the internationalisation of industrial relations."

"La politisation croissante et l'intensification du programme européen « Mieux légiférer », y compris le REFIT (« programme de remise en forme réglementaire et performance »), ont conduit à l'introduction d'une rhétorique communautaire selon laquelle tout projet de loi et tout acte législatif sont considérés comme des obstacles à la croissance, la compétitivité et l'emploi, surtout pour les PME. Nonobstant la critique selon laquelle cette initiative est très couteuse notamment en terme de ressources, elle est qualitativement discutable en particulier en ce qui concerne les évaluations d'impact, au point où le REFIT peut apparaître comme une menace réelle pour l'acquis social de l'Union européenne. Sous couvert d'une nécessaire modernisation du droit du travail, notamment pour vaincre une bureaucratie réglementaire européenne, le programme « Mieux légiférer » s'emploie à tenter de déréguler l'acquis social communautaire, tout en instrumentalisant les principes qui fondent l'Union européenne, et ce, en l'absence de légitimité démocratique sur lequel repose l'ensemble du mécanisme. "

"This collection addresses the potential of the European Social Charter to promote and safeguard social rights in Europe. Drawing on the expertise of the ETUI Transnational Trade Union Rights expert network from across Europe, it provides a comprehensive commentary on these fundamental rights. Taking a two part approach, it offers an in-depth legal analysis of the European Social Charter as a new social constitution for Europe, investigating first the potential of the general legal frame in which the Charter is embedded. In the second phase a series of social rights which are related to the employment relation are examined in particular in light of the jurisprudence of the European Committee of Social Rights (ECSR), to demonstrate the crucial but difficult role of the Charter's supervisory bodies to secure the respect and promotion of social rights and national level, bearing in mind the reciprocal influence of other international social rights instruments. This examination is timely, given the pressure exerted on those rights during the recent period of economic crisis. Furthermore, in the light of the predominantly economic vision of Europe, such analysis is crucial.
