"Veränderte Rahmenbedingungen erfordern eine geänderte Rspr. und mutige Initiativen des Gesetzgebers. Ansonsten werden insbesondere die fortschreitende Digitalisierung, die Transformation weiter Bereiche der Wirtschaft, auch vor dem Hintergrund von Umweltfragen, und die Globalisierung der UN die Betriebsverfassung weiter aushöhlen und entwerten. Wichtig sind vor allem stärkere Rechte der BR bei Beschäftigungssicherung, betrieblicher Weiterbildung und Personalplanung. Der Schutz der Persönlichkeitsrechte der AN durch den BR muss ebenso verstärkt werden, wie seine Rechte in Fragen der Gleichstellung, der Integration von Beschäftigten mit Migrationsgeschichte und bei der internat. Vernetzung in Konzernen. Schließlich sind auch die Arbeitsgrundlagen der BR zu modernisieren. Insbes. Betriebsratswahlen sind deutlich zu erleichtern und die Möglichkeiten des § 3 BetrVG auszubauen.

Altered general conditions require altered jurisdiction and courageous initiatives of the legislator. Otherwise, in particular increasing digitalisation, transformation of large areas of economy, also against the background of environmental issues, and globalization of companies will further undermine and devalue operational codetermination. Of particular significance are stronger rights of the works councils as regards securing of employment, operational further training, and staff planning. Protection of personal rights of employees on part of works council needs to be enhanced as well as works council's rights regarding issues such as equalization, integration of employees with migrant background, and international networking in groups of companies. And finally, also the working basis of works councils is to be modernized. In particular, works council elections must be considerably facilitated, and the opportunities of § 3 BetrVG (Works constitution Act) are to be expanded."
