"Am 8.4.2020 hat das Kabinett verschiedene Änderungsvorschriften beschlossen: für PR auf Grundlage einer VO sowie im BPersVG, als Sonderregelungen für BR im BetrVG und für andere nat. und eur. Interessenvertretungen im SprAuG, EBRG, SEBG und SCEBG. Sie wurden allesamt begründet mit dem Erhalt der Handlungs- und Beschlussfähigkeit insbes. der Interessenvertretungen (erschwerte Beschlussfassung in Präsenzsitzungen) bzw. zur Vermeidung von Infektionsrisiken durch die Zusammenkunft vieler Beschäftigter (etwa in Betriebsversammlungen) unter den massiven Einschränkungen infolge der Corona-Pandemie.

Virtual Decision-Making for Workers Representatives are possible until the end of 2020

On April 8, 2020, the German Cabinet passed various changes in legislation for workers representations: for staff councils in the Public Service Sector based on a Regulation and in the Federal Staff Representation Act (BPersVG), as special regulations for works councils in the Works Constitution Act (BetrVG) and for other national and european workers representatives in the Act on Spokesmen for Senior Executives (SprAuG), European Works Council Act (EBRG), Act on Employee Involvement in Societas Europaea (SEBG) and Act on the Involvement of Employees in a European Cooperative Society (SCEBG). They were all justified with the preservation of the ability to act and make decisions, especially of the workers representatives (difficult decision-making in face-to-face meetings) or to avoid infection risks due to the gathering of many employees (e.g. in works meetings) under the massive restrictions resulting from the corona pandemic."
