No turning back from Social Europe: a new interpretation of the refurbished Posted Workers Directive in Hungary and Poland
"In December 2020, the Grand Chamber of the CJEU dismissed Hungary and Poland's actions challenging the legality of Directive 2018/9571 revising the Posted Workers Directive2 (hereafter ‘PWD'), bringing an emphatic end to the political debate surrounding this controversial reform.3 This note provides an overview of the revision with a focus on the amendments to the PWD that were challenged by Hungary and Poland and evaluates the two judgments in an attempt to capture the Court's current stance on the aims of the PWD and its place in the EU legal order."
