"Das BetrVG sieht etliche Arbeitnehmervertretungen vor, eine von ihnen ist der BR. Rechte und Pflichten des BR sind im BetrVG geregelt BR. Zum BR aktiv wahlberechtigt sind nach § 7 S. 1 BetrVG alle AN des Betriebs, die das 18. Lebensjahr vollendet haben, wobei zu den AN iSd. Betriebsverfassungsrechts auch die Auszubildenden gehören (§ 5 Abs. 1 S. 1). Minderjährige AN sind somit von der Wahl des BR ausgeschlossen. Sie haben allein die Möglichkeit, gem. § 60 Abs. 1 eine JAV zu wählen. Die JAV hat im Vergleich zum BR beschränkte Rechte und die des BR betreffen minderjährige AN. Dieser Beitrag zeigt die Relevanz der Vertretung minderjähriger AN durch den BR auf und argumentiert, dass der Ausschluss minderjähriger Betriebsangehöriger von der Wahl zum BR sowohl gegen Europarecht als auch gegen das GG verstößt.

The age of election in the Works Constitution – An analysis under European and Constitutional Law

German labour law provides for employee participation in numerous ways, one of them being works councils (BR). Rights and duties of the works councils are governed by the BetrVG (Works Constitution Act). Pursuant to the BetrVG, only employees over 18 years elect the BR, whereas underage employees are excluded from this election. They may only elect the JAV (Youth and Trainee Representations). The JAV has very limited rights compared to the BR, whose decisions also concern underage employees. This article outlines the relevance of participation of underage employees to the BR and argues that the exclusion from the BR election on grounds of age violates European law and the German constitution."
