"With the decline of the nation-state, which is a pillar for labour law, a new phase has opened that we call denationalisation of labour law, in which supranational control centres play a growing role on markets and economy. The essay discusses some of the main issues arising from such developments and uses the concept of "subordination" to describe how labour law is conditioned by external factors unrelated to those that have historically contributed to the construction of this branch of law."

"The concept of poor work is considered in broader terms and not limited to the condition of economic hardship faced by the worker. In the so-called gig economy the meaning of the term "poverty" lends itself to be understood first, as underpaid and poorly protected gig work, but also, and secondly, as a poverty of the underpinning concepts and theories that labor law can employ to frame the digital economy and to counteract the current storytelling related to digital innovations. Elements are identified, such as algorithmic management, datification and gamification, highlighting that the freedom of gig workers actually hides a form of self-exploitation induced by the technical operating models of the platforms themselves. The “smart exploitation therefore alludes to a model of technoregulation that promotes the fake self-employment of gig workers."
