"Das internationale und europäische Arbeitsrecht wird immer wichtiger. Grenzüberschreitende Sachverhalte nehmen in einer globalisierten Wirtschaftsumgebung ständig zu, Entsendungen sind an der Tagesordnung, das Zusammenspiel von nationalen, europäischen und internationalen Regeln ist vielfach schwer zu verstehen. Der Einfluss der europäischen Richtlinien auf die nationale Gesetzgebung ist erheblich, die internationalen Regeln wirken zum Teil unmittelbar.
Der neue Großkommentar trägt dem durch eine englischsprachige Kommentierung aller relevanten Regelungen auf internationaler und europäischer Ebene Rechnung. Artikel für Artikel werden die wesentlichen Vorschriften systematisch erfasst, im Einzelnen erläutert und damit für die Beratung verständlich gemacht.

"There is widespread evidence that mental health is a key issue in today's workplace. Stress, depression and anxiety are the leading causes of sickness absence, while people with mental health problems report frequent experiences of discrimination at work. Research also shows low employment participation rates amongst those with mental health problems. This article explores the role that employment law can play in fostering a more inclusive labour market, looking specifically at the duty to make reasonable adjustments in the Equality Act 2010. It examines how tribunals and courts have interpreted the duty, finding evidence that the multi-stage test commonly followed creates obstacles for claimants, as well as giving rise to ambiguity and, at times, inconsistency. The article concludes that the duty to make reasonable adjustments can be a valuable resource for people with mental health problems and there is evidence that it is provoking change in employment practices. Yet the potential contribution of the duty remains constrained by restrictive interpretations of the law."

"The Part-Time Work Directive contains two core objectives: removing discrimination against part-time workers and promoting the flexible organisation of working time. This article examines the extent to which these objectives have been realised in the measures taken in Britain to implement the directive. The Part-Time Workers Regulations were the primary legislative response and these provided a new right for part-time workers to protection from less favourable treatment. The broader objective of promoting flexible working was not expressly addressed within the regulations, but in the subsequent period a range of relevant legal interventions emerged. The picture that results is one of partial and incomplete implementation. The case law illustrates some of the difficulties facing litigants in enforcing equal treatment rights. Progress in promoting flexible working has yet to alter the underlying disadvantages encountered by part-time workers, namely the association of part-time work with low-pay and low-status jobs. These findings imply the need for further law and policy to respond more effectively to the directive's objectives."

"The Constitution for the European Union adopted in June 2004 contains a variety of articles that relate to equality. These provisions are scattered across the different parts of the Constitution and equality emerges as simultaneously a value, an objective, a fundamental right, a positive duty and a legal competence. This article examines these multiple reference points in the light of three underlying themes. First, there is an analysis of the concepts of formal equal treatment and substantive equality. Secondly, the balance between negative duties to refrain from discrimination and positive duties to promote equality are considered. Finally, the challenge of ensuring equal protection whilst respecting and accommodating diversity is explored."

"This article explores how anti-discrimination law has been applied in relation to employment discrimination faced by people with intellectual disabilities. Although disability discrimination laws are now found in many states, there has been relatively little litigation by those with intellectual disabilities as regards employment discrimination. This article examines experience in the USA in order to identify the potential of anti-discrimination law, as well as its limitations in practice. It considers litigation brought by individual plaintiffs, as well as enforcement actions by public bodies. This concerns employment in the open labour market, but also sheltered employment schemes. The article concludes by reflecting on what lessons may be derived from US experience."

" People with intellectual disabilities occupy a peripheral position in the labour market. They have low rates of participation in employment and this often takes the form of sheltered employment in settings segregated from persons without disabilities. Although their working lives have received limited attention in legal scholarship, this article argues that law can play a positive role in fostering greater inclusion. Taking into account the UN Convention on the Rights of Persons with Disabilities, this article analyses EU legislation and case law in order to identify how these apply to those working in sheltered employment and how they may assist in tackling barriers to participating in the open labour market. While EU labour law already contains measures that have the potential to improve the position of people with intellectual disabilities, the article identifies scope for enhancing the effectiveness of these instruments."
