"Vor 100 Jahren, am 12. Februar 1920, ist das »Betriebsrätegesetz« (BRG) im Reichsgesetzblatt veröffentlicht worden. Das gibt unvermeidlich Anlass zu Nachdenken im Namen des damit verbundenen 100-Jahres-Jubiläums. Es ist gewissermaßen ein »Nachklang« der Jubiläen zur Novemberrevolution und dem Stinnes-Legien-Abkommen 1918 – mit dem gemeinsamen Nenner eines demokratischen und sozialen Aufbruchs, der Erst-Ausgabe einer Arbeitsverfassung, wie sie in nunmehr in 70 Jahren Bundesrepublik zur Reife gelangt ist: Tarifvertrag und Betriebsverfassung als deutschlandtypisches Modell einer dualen Interessenvertretung. Dieser Beitrag geht auf bislang eher unterbelichtete Aspekte der Entstehung des BRG ein.

Works Council Act of 1920: Prehistory and Its Coming into Being

100 years ago – on 12 February 1920 – the »Works Council Act« [Betriebsrätegesetz (BRG)] was published in the German Reich's legal gazette. Unavoidably, this is an occasion to think and remember the associated 100th anniversary. It is – so to speak – a „reverberation“ of the anniversaries of the November revolution and the Stinnes Legien Treaty of 1918, with the common denominator of a democratic and social awakening – the first issue of a works constitution – as it has come to maturity in the past 70 years of the existence of the Federal Republic of Germany: collective bargaining agreement, and employee's representation as the typical German model of dual representation of interests. This article sheds light on so far neglected aspects of the creation of the BRG."
