"The recently adopted “Act on Genetic Testing in Humans” (Gendiagnostikgesetz) establishes binding regulations regarding genetic testing and how the of the results of such testing may be used. Art. 19–22 of the Act deal specifically with genetic testing in working life, which it clearly restricts, although not without exceptions. The combination of the basic prohibition of such examinations with a specific ban on discrimination, also in case of an employee's refusal to be tested, is intended to prevent discrimination. However, there are exceptions to this prohibition, which the law describes in detail. On the whole, the author comes to a positive assessment of the act."
