"The essay deals with the issue of minimum wages to be paid to workers posted in Italy, within the framework of the law transposing Directive 96/71. The proliferation of national collective agreements (Ccnl) enlarges the problem of identifying the minimum standards of general application in the various economic sectors. A crucial problem, since only once the generally applicable minimum standards are identified they can be extended to foreign companies, without violating the principle of non-discrimination. These issues concern workers employed in both private contracts and (even more) public procurements, given that, also in this latest case, wage setting must take into account the same internal market principles, which are relevant for the regulation of posting."
