"This book by the ETUI Transnational Trade Union Rights Expert Network analyses enforcement as a key element making EU labour law effective or ineffective.

Enforcement is the key ingredient that makes rights effective and ensures compliance. It can make or break a legal system. Despite this, enforcement of EU labour law has received little scholarly attention in recent decades and has rarely been examined in a comprehensive way. This book aims to fill this gap.

Intended for academics and practitioners alike, the book adopts a threefold approach to examine this issue. First of all, it explores the idea of effective enforcement and sets out the wider context in which EU labour law enforcement takes place. Secondly, it analyses how enforcement operates in particular areas, including non-discrimination, health and safety, information and consultation rights, and the rights of migrating workers. Thirdly, it critically assesses the role of specific actors (in particular collective actors like trade unions, as well as whistle-blowers and the European Labour Authority) and settings (public procurement, economic and monetary policy) regulated by EU law. Drawing on the insights produced by these analyses, the book concludes by proposing a comprehensive Draft for a Model Directive on 'Effective Enforcement of EU Labour Law' as an inspiration for policy development and scholarly debate in this area."

"This report was produced by a group of independent experts, all of them labour lawyers, and most of them academic labour lawyers, with a view to assisting the ILO in the context of the ongoing technical assistance programme developed with the Greek Government in a number of areas, including “labour legislation to regulate collective dismissals”.

As is widely known, since May 2010 the Union's Euro-area Member States and the International Monetary Fund (IMF) have been providing financial support to Greece through an Economic Adjustment Programme in the context of a sharp deterioration in the country's financing conditions. This support has been accompanied by a request on the part of the lending institutions' representatives to implement a number of reforms aimed at improving the competitiveness of the Greek economy. Amongst a series of detailed specifications, Greece has been asked to adopt “reforms [that] will ease interpretation of and foster compliance with labour laws with a view to bring legislation in line with EU best practices, and to this end a review will be carried out […], comparing Greek regulations on […] collective dismissal rules and procedures, with those in other EU Member States”."

"In assessing the impact at firm, sectoral and cross-sectoral level the report seeks to identify what arrangements can be compatible with the goals of promoting sustainable and inclusive growth. Methodologically, the report has been compiled by relying on a number of tested deskbased and empirical research tools utilizing published quantitative data, mining our existing qualitative data and conducting new empirical research in the service sector. The report builds on a legal analysis of
primary and secondary sources, a state-of-the-art review of economics and comparative industrial relations research, a quantitative (descriptive) analysis of collective agreements, analysis of interview data with key informants plus documentary material at sectoral/occupational level, and original casestudy evidence at company level. In parts, the report relies on and updates research already conducted by the team on the crisis-related measures affecting labour market regulation and their potential implications for joint regulation via collective bargaining."

"Under external pressure, the Greek system of industrial relations has undergone radical regulatory changes since 2010. These have led to a significant contraction of higher level bargaining and a process of disorganized decentralization, bringing the collective bargaining system to a brink of collapse. Emerging demands on the part of both employers and unions to preserve multi-level bargaining, together with greater support on the part of the state, could halt or even reverse some of these trends. But the scope for success of such efforts depends on how far ‘regulated austerity' continues to dominate European policy."

"This book presents the results of a research project which sought to understand how the crisis-driven labour policy measures in the EU Member States most affected by the crisis translated into changes in collective bargaining in manufacturing. Drawing on empirical evidence consisting of interviews with policy officials and industrial relations actors as well as of company case studies in seven countries (Greece, Ireland, Italy, Portugal, Romania, Slovenia and Spain) the book illustrates how the recent policy measures have resulted in a crisis of collective bargaining at different levels, including not only national but also sectoral and company levels.



In most cases, the structure, process, content and outcomes of collective bargaining have been undermined calling into question the capacity of the industrial relations actors to respond and regulate terms and conditions of employment in the post-crisis period. However, there is also evidence of institutional and organisational resilience and reconfiguration in the process of responding to and accommodating the labour policy measures, most notably in industrial relations systems that were characterized by strong bargaining arrangements in the pre-crisis period."
