The European architecture for the protection of fundamental rights combines the legal regimes of the states, the European Union, and the European Convention on Human Rights. The purpose of this book is to analyse the constitutional implications of this multilevel architecture and to examine the dynamics that spring from the interaction between different human rights standards in Europe. The book adopts a comparative approach, and through a comparison with the federal system of the United States, it advances an analytical model that systematically explains the dynamics at play in the European multilevel human rights architecture. It identifies two recurrent challenges in the interplay between different state and transnational human rights standards-a challenge of ineffectiveness, when transnational law operates as a ceiling of protection for a specific human right, and a challenge of inconsistency when transnational law operates as a floor-and considers the most recent transformations taking place in the European human rights regime. The book tests the model of challenges and transformations by examining in depth four case studies: the right to due process for suspected terrorists, the right to vote for non-citizens, the right to strike and the right to abortion. In light of these examples, the book then concludes by reassessing the main theories on the protection of fundamental rights in Europe and making the case for a new vision-a 'neo-federal' theory-which is able to frame the dilemmas of identity, equality and supremacy behind the European multilevel architecture for the protection of human rights."

"Cet article étudie le droit de grève au sein de l'Union européenne ainsi que l'enjeu inhérent à l'interaction des droits sociaux protégés par les législations internes des États membres avec les règles européennes relatives au marché commun. Il examine, dans une approche comparative, des dynamiques analogues qui ont eu lieu aux États-Unis entre le droit fédéral et les droits des États fédérés. Il montre qu'aux États-Unis la tension entre droits sociaux et principes du libre marché a pu être encadrée pendant la période du New Deal par le Wagner Act, qui a consacré la protection du droit de grève au niveau fédéral. L'auteur propose d'adopter un règlement européen prévoyant la protection du droit de grève par le droit de l'Union et analyse le potentiel d'une telle initiative en vue de la création d'un nouvel équilibre entre protection sociale et intégration économique au sein de l'Union européenne."

"This article analyses from a law and policy perspectives the measures adopted by the European Union (EU) to address the devastating economic effects of COVID-19, assessing their implications for Europe's economic and monetary union (EMU). The article first sets the background by exploring the main features of EMU before COVID-19. Subsequently, it examines the multiplicity of policies deployed by the EU institutions to contain the socio-economic damages of the pandemic – including, most crucially, the EU recovery fund "Next Generation EU" – and underlines their transformative effect on the EU architecture of economic governance. As the article argues, the responses to COVID-19 have produced a significant rebalancing of EMU, bridging the asymmetry between EU monetary and economic policy. Finally, the article considers whether the COVID-19-related responses are likely to be only temporary, or rather a new normal for EMU, and sheds light on further constitutional adaptations which are needed to sustain this unprecedented transfer of fiscal power to the EU level."
