"Terms such as 'Social Europe' and 'European Social Model' have long resided in the political and regulatory lexicon of European integration. But in recent years, and in spite of the adoption of the Charter of Fundamental Rights, the EU social profile has entered a profound period of crisis. The ECJ judgments of Viking and Laval exemplify the unresolved tension between the EU's strong market imperatives and its fragile social aspirations while the ongoing economic crisis, while the various 'bail out' packages are producing a constant retrenchment of social rights. The status quo is one in which workers appear to shoulder most of the risks attendant on making and executing arrangements for the doing of work. Chapters in this book advocate a reversal of this trend in favour of fair mutualization, so as to disperse these risks and share them more equitably between employers, the state, and society at large."

"Aux Pays-Bas, quinze ans après l'accord et la loi Flexibilité et Sécurité, les formes flexibles d'emploi se diversifient toujours plus et représentent près de 30 % de l'emploi. Conjugué avec la reprise du chômage depuis 2008 et le ralentissement des sorties vers l'emploi stable, le volume de cet emploi flexible crée un sentiment d'insécurité sociale. Dans un accord social négocié en avril 2013 avec le gouvernement, les organisations syndicales ont obtenu certains correctifs aux abus les plus criants de la flexibilité mais ont été contraintes à des concessions sur la procédure de licenciement et l'indemnisation du chômage auxquelles elles avaient réussi à résister jusque-là."

"The social impact of the financial crisis has been weakened by two elements: the short-time policy promoted by the Government and the social partners concertation. The legal restructuring of the labour market had taken place relatively long before, and independently from, the financial crisis. However, the labour and social security law reforms have contributed to the characteristic segmentation (“dualisation”) of the German labour market. "In the wake of increasing globalization and economic and financial crisis, the balance between flexibility and security - flexicurity - is central to European employment policies and the modernization of EU labour law in the different Member States of the EU. Common principles of flexibility have been adopted, and different pathways to flexicurity have been outlined. The aim of this paper is to critically analyse developments in Swedish employment protection regulation, with a special focus on dismissals for reasons of redundancy, in light of the EU flexicurity discourse. The notions of employability and equal treatment come to the fore. Central research questions involve the design and content of employment protection regulation and employment protection and employability within collective bargaining and the industrial relations system. Attention is paid to recent changes and developments in legislation, case law and collective bargaining, and to whether employment protection is being deregulated. The paper integrates labour law and industrial relations approaches, and encompasses analyses of legal materials at different levels, as well as industrial relations aspects."

"This article considers the interaction between labour law and employment policy at European Union (EU) level in the light of recent political and legal developments. It begins with a consideration of the relationship between labour law and policy as a function of the political compromise at the foundation of the EU (i.e., its establishment on an economic rather than social basis). This article then discusses the application of the relationship between labour law and policy in terms of the policy provisions of Directive 2000/78 (derogation on 'employment policy grounds') as opposed to the policy provisions of the atypical work directives (the policy of 'flexicurity'). It considers these directives in the light of the recent development of case law in this area (e.g., Case C-555/07, Kükükdeveci v. Swedex Gmbh & Co. KG and its relationship to C-144/04, Mangold v. Helm ) and illustrates the difficulties of the inclusion of policy objectives within the law. This article then goes on to assess the future relationship between law and policy in the EU and particularly the potential impact of incorporation of the Charter of Fundamental Rights and Freedoms 2000 into the Lisbon Treaty on the development of labour law and policy."
