"In the article, the regulatory trajectories of variable hours contracts (VHCs, denoting oncall contracts, and zero-hours contracts) are analysed in two countries, the Netherlands and Finland. The unity or disunity in social partners' readiness for bringing the issue of VHCs to the agenda of collective bargaining has implications for the labour market regimes. From the institutional change perspective, the shared agenda in regulating the VHCs implies conversion of the labour market regime in the Netherlands. In Finland, layering was seen in the development of labour legislation, whereas the disregard of VHCs in collective bargaining implies drift. In Finland, the ‘legislative route' of regulating conditions of labour may strengthen, undermining the negotiatory autonomy of social partners, earlier embedded in the structure of the Nordic labour market regime."

"In France, the growth of digital labour platforms has benefited from the support that has been provided by one section of the governing political class for the sake of the ‘employment opportunities' that they are expected to generate. However, their operating model, which relies on outsourced labour carried out by supposedly self-employed workers, has been the subject of inspection operations and objections initiated by the social security agencies and institutions that ensure compliance with labour law. Based on interviews with these stakeholders – labour and social security inspectors – this article illustrates how they are seeking to reintegrate these workers into the employed workforce, not only for the purpose of maintaining their safety at work but also with a view to preserving the French social model. These inspectors rely on their traditional control tools but also on the framing of anti-fraud policies. Ultimately, their actions seek to inform legal disputes with a view to reclassifying the workers concerned."

Aus der Pflicht zum Erhalt unserer natürlichen Lebensgrundlagen und der Unversehrtheit zukünftiger Generationen erwachsen dem Gesetzgeber Schutzpflichten, die potenziell die gesamte Rechtsordnung betreffen, wie das Bundesverfassungsgericht im so genannten Klima-Beschluss vom 24.3.2021 festgestellt hat. Es liegt auf der Hand, dass auch das Arbeitsrecht hiervon erfasst ist.

Prof. Dr. Wolfgang Däubler entwirft eine innovative Gesamtschau, die zeigt, wo die Belange des Klimaschutzes im Arbeitsrecht relevant werden. Ausgehend von grundsätzlichen Überlegungen und persönlichen Beobachtungen beschäftigt er sich mit dem Stellenwert des Klimaschutzes gegenüber der unternehmerischen Freiheit, kollektiven Handlungsmöglichkeiten zugunsten von mehr Klimaschutz und den Aspekten, in denen der Klimaschutz im Arbeitsvertragsrecht relevant wird."

"Over the past decades, many Western countries have witnessed a substantial increase in flexible employment relationships. Flexible employment contracts are especially prevalent among people under the age of 35. This dissertation explores how young adults and employers relate flexible employment to the transition to adulthood and how both parties perceive disadvantageous consequences of flexible employment. Analyses are based on new data from qualitative interviews, surveys and a vignette study, all collected in the Netherlands.

Findings show that employers and young adults each have their own perspective on flexible employment and that these perspectives do not match. Employers displayed a clear liking for the use of flexible employment contracts because they believe it benefits business operations. In practice, however, strategic motives for the use of flexible contracts may counteract. Employers also reported distinct downsides to flexible employment in terms of unclear human resource management and lower employee well-being.

Young people's perspective on flexible employment turned out to be informed by the experience of key life events that constitute ‘adulthood'. Young adults showed a clear distaste for flexible employment contracts, especially types that offer low income- and job security. Young people in flexible employment also worried more about how their future life might or might take shape than those in permanent employment.

The dissertation concludes that a substantial share of young adults face the challenge of building a life under insecure conditions and that employers are unlikely to act on this societal problem."
