Safety Science - vol. 108

Safety Science

"“Human error” is often implicated as a causal factor in accident investigation yet very little is done to understand ‘why' such errors occur in the first place. This paper uses the principles of Schema Theory and the Perceptual Cycle Model (PCM) to further explore the circumstances surrounding the fatal Tesla crash in May 2016 in which the driver was fatally injured using team-PCM representations. The preliminary National Highway Traffic Safety Administration accident investigation concluded that the driver of the Tesla Model S was at fault. However, the analysis presented in this paper argues that rather than “driver error”, the underlying cause of this tragic incident could be in fact more akin to a “designer error” implicating the design of the Autopilot feature itself. This is in line with the National Transportation Safety Boards more recent announcement that suggests systems design may have contributed to the crash. It would therefore appear that the drivers expectation of system functionality may not have matched the real life capabilities of the system. This is likely to be a product of inappropriate mental models relating to system function."

Relations industrielles - Industrial Relations

"With the introduction of digital platforms in the Canadian labour law's landscape comes an increased used of agreements imposing arbitration as a dispute resolution mechanism. To challenge their classification as independent workers and gain employment standards acts' protection, gig workers therefore need to submit their disputes to a private proceeding, often located outside Canada. It is in this context that the Ontario Court of Appeal's decision to invalidate the arbitration clause in Heller v Uber Technologies Inc. must be read. Having granted leave for appeal, will the Supreme Court of Canada follow in the footsteps of American law and allow mandatory arbitration agreements to impede collective actions challenging the misclassification of gig workers? Our study of the Ontarian and American decisions regarding the validity of mandatory arbitration agreements between Uber and its drivers brings to light the determining impact of the approach chosen by courts."

The Economic and Labour Relations Review - vol. 35 n° 3 -

The Economic and Labour Relations Review

"This special Themed Collection of The Economic and Labour Relations Review examines the ‘Economics of Occupational Health and Safety' (OHS). The economics of OHS looks at how economic structures and incentives, including labour markets and production processes, influence the health and wellbeing of workers and the communities where they live. It is a large and diverse subject that has been viewed from multiple different lenses. This thematic issue can only touch on some of these but will remind readers how economic incentives and industrial competitive pressures affect OHS. This editorial will take the form of an article which explores some of these intersections and places them in a wider context. To do this, the economics of OHS will not only be examined in terms of economic welfare and microeconomics at the industry and workplace level, but also from an historical perspective, as well as the intersection of these levels, thus providing a useful framework to shape research and discussion."

"We illustrate the exploitation in the relationship between Uber and its drivers by aligning their work with the characteristics of neo-villeiny. Two different legal developments in response to irregulation (or the lack of effective regulation) in similar institutional contexts emerge. While Uber drivers in the United Kingdom now have worker status, dysregulation (by which we mean regulation that exacerbates the problem it seeks to resolve) in Ontario has established neo-villeiny in law."
