"This report identifies trends in cross-border company mobility (CbCM) in the European Union (EU) and European Economic Area (EEA), defined as encompassing cross-border mergers, cross-border conversions, cross-border divisions and cross-border seat transfers of SEs (Societas Europaea). Moreover, the report also looks at the creation of SEs.

Overall, the data shows that cross-border company mobility is a phenomenon of the 21st century, and particularly of the last 10 years: integration in the form of a freedom of establishment for companies through corporate mobility has existed only in this millenium and has increased steadily since the early 2000s. "This book sets out to answer two main questions: what is the status quo of the position of Dutch works councils in multinational corporations? And which tools within the Dutch legal framework can be utilised in order to secure the successful involvement of the works council in the decision-making process in light of the increasingly globalised economy?
The findings show that many participation rights are frequently used in practice, but not always. The inventory of good practices further revealed that a multitude of potential solutions are applied in practice. They show that, through negotiation and long-term experiences with participation mechanisms, tailor-made employee participation processes can be achieved.
Overall, the position of the examined Dutch works councils is solid. However, works councils, management and supervisory boards and other stakeholders need to work on several aspects in order to improve the position of works councils and to safeguard their statutory rights – a theme that is emphasised throughout this study."

"This report on cross-border mobility in the European Union focuses, in its second edition, particularly on cross-border mergers and cross-border seat transfers between 2013 and 2018. Compared to the last report, a comprehensive country-by-country reporting for each EU and EEA Member State has been added to provide a fuller picture of cross-border company mobility in the EU."
