"This article examines the employment policies implemented in Spain since the onset of the crisis and highlights the consequences of the major legal changes that have been passed. Preceded by an overview on the strong and weak points of the Spanish labour market before the onset of the crisis, the first part of the analysis focuses on the labour reform implemented by the socialist government before 2012, marked by a deteriorating economic and social context with mounting unemployment and by a limited shift towards deregulation. Then the article offers some critical thinking on the new policy stage opened in Spain after the right-wing party gained an overwhelming majority in Parliament in November 2011, arguing that the magnitude of the legal changes introduced in 2012 is such that we might speak of a new Spanish model of industrial relations, a model of “flexinsecurity”. This section outlines how the reform (labour “disruption”) breaks the traditional balance between employers and employees, examining the following issues: the new forms of instability in hiring; how employers are allowed to impose internal flexibility on workers; the new and devalued collective bargaining system; and the easier and cheaper regime of dismissal. Finally, the article analyses the legal measures implemented in 2013 to complete that major reform."

"This article aims to shed light on one crucial aspect of the ‘gig' economy: the extent to which the new forms of work in this field undermine the pillars upon which traditional Bismarckian systems of social security have been built. Focusing on Spain, three main issues are analysed. First, after considering the legal classification of this type of service provision and its implications, the scheme within the social security system that corresponds to the registration of the service providers is identified. Second, how registration and subsequent social security contributions affect the generosity of social benefits is clarified. In particular, attention is paid to both the risk of partial, or total, lack of, protection due to the absence of compulsory contributions and the low-level of contributions made by the self-employed. And third, the impact the development of the platform economy may have on the financing of social security and its future sustainability – given the current difficulties confronting the Spanish economy – is examined. Some recommendations relating to these three issues are outlined as concluding remarks. "

" This paper introduces the topic of the internal coordination of regional and local social security schemes in Spain. In the field of social security, the constitutional framework imposes different solutions in terms of the division of competences between State and Autonomous Communities, depending on the branch of (public) social protection. In the provision of long-term social care, for instance, both the State and the Autonomous Communities participate. Healthcare services are mainly provided by the Autonomous Communities without prejudice to certain aspects of the role played by the State. Social assistance through cash benefits or social services are exclusively provided by the Autonomous Communities, with the deep participation of local entities, especially in the case of social services. The paper outlines the extent of devolution and decentralisation, and the adjudication of competence and financial arrangements. The final section addresses some specific questions in healthcare, long-term social care and social assistance."
