"Jüngst, am 23. 2. 2022 und damit fast 9 Jahre nachdem das Fabrikgebäude Rana Plaza in Bangladesch zusammenbrach und 1.134 Menschen in sich begrub, hat die EU-Kommission ihren Vorschlag für eine RL über die Sorgfaltspflichten von Unternehmen im Hinblick auf Nachhaltigkeit vorgestellt (Corporate Sustainability Due Diligence Directive, COM(2022) 71 final). Der Entwurf umfasst eine große Vielzahl von Menschenrechten und Umweltbelangen und zielt auf eine EU-weite Harmonisierung der Sorgfaltspflichten ab. Billigen das EP und der Rat den Vorschlag, haben die MS binnen 2 Jahren ihr nat. Recht den in der RL enthaltenen Vorgaben für besonders große Unternehmen (siehe II.) anzupassen; weniger große Unternehmen sollen 2 weitere Jahre Zeit erhalten, sich auf die Sorgfaltspflichten vorzubereiten (Art. 30). Das Schutzniveau in bereits bestehenden nat. Sorgfaltspflichtengesetzen – in Deutschland das Lieferkettensorgfaltspflichtengesetz (LkSG) – darf dabei nicht abgesenkt werden (Art. 1 Abs. 2).

Im Folgenden wird der Inhalt des Vorschlags zusammengefasst, mit dem LkSG verglichen und bewertet.

Sustainability in Supply Chains: On EU Legislation on Duties of Care

Most recently, on 23/02/2022, and hence almost nine years after the collapse of the factory building Rana Plaza in Bangladesh with 1,134 casualties, the EU Commission presented its proposal for a directive on corporate duties of care with view to sustainability (Corporate Sustainability Due Diligence Directive, COM (2022) 71 final). This draft includes a great number of human rights and environmental issues, and aims at an EU-wide harmonisation of duties of care. In the event, the European Parliament and the Council approve of this draft, member states will have to adjust their relevant national legislation to the stipulations covered by this directive within a period of two years; this refers, in particular to large companies (see II.); smaller companies shall be granted a grace period of two more years to prepare for the new duties of care (Article 30). The level of protection included in already existing national duty of care laws – in Germany, this is the Supply Chain Duty of Care Act (LkSG) – must not be lowered (Article 1 (2)).
