"The place of age as a distinctive protected characteristic is examined within the general system of non-discrimination at EU as well as national level. Perhaps one of the most intriguing questions to answer is: How are rules applied in practice? Differentiation in treatment based on age remains common both in Austria and Hungary. Some key areas such as mandatory retirement for judges, general schemes of salary in the public sector, expiration of rights and retroactive effect of Directive 2000/87/EC have been recently put to the test of the CJEU."

"Esta presentación explora los recientes desarrollos y cambios en la Ley de Coordinación de la Seguridad Social en el campo de la enfermedad y la maternidad según el Reglamento 1408/71, que dio lugar a la adopción de un nuevo Reglamento 883/04 del Consejo en el año 2004. El texto analiza los efectos de los cambios en el ámbito personal y material de aplicaci ón, así como la incorporación de una abundante jurisprudencia, que debería hacer más transparente la Coordinación. Se dirige un interés especial a la situación de los pensionistas y trabajadores transfronterizos y a la introducción de la Tarjeta Sanitaria Europea."

"Austria amended legislation, adjusting family benefits such as the family allowance and the deductible family allowance amount to the (lower) price level indices for consumer goods and services (indexation) of the State of residence of the child. This case is not a unique case. In the European Union, similar endeavours were envisaged in several Member States. The Austrian legislation, however, is now being challenged before the CJEU. In the authors' opinion, this unsuitable cost-saving budget measure contradicts Union law. Consequently, the provisions concerned must remain unapplied. After all, since the Austrian legislation is obviously incompatible with primary Union law, authorities or courts are not even required to refer the matter to the CJEU."
