"If the phenomenon of ‘new self-employed workers' or ‘bogus self-employed workers' is nothing new, this phenomenon is growing. The crisis which gripped the EU saw a rise in practices from a bygone age: self-employed people working under very degrading conditions in return for payment considerably below the average applicable in the host State and subject to violations of human dignity. The article shows that the increase in temporary cross-border movements appears to be a reality which collides head-on with national labour and social security law, ill-equipped to counter the abuse of opportunities afforded by European law."

The purpose of this survey is not to present the state of transposition of the Posting Directive in different Member States, but to highlight the necessity of improving the quality of information provided to undertakings and workers. The effectiveness of the rule of law presupposes a proper understanding thereof by the stakeholders, both in the case of those required to apply these rules and the beneficiaries. Proper identification of the stakeholders for a better understanding of their respective needs is an essential factor in the delivery of adequate and better information. Yet, it appears today that the information is mainly directed towards foreign undertakings present on national territory in the framework of a temporary service offer in application of the Directive 96/71 on the posting of workers. It seldom concerns undertakings established on national territory who wish to temporarily post workers to another Member State or who want to use such a provision of services themselves. It is also rare that such information is directed towards the posted workers. ..."

Cette complexité justifie à elle seule que l'attention soit portée sur la manière dont les protagonistes ont aujourd'hui accès à l'information nécessaire pour assurer la sécurité juridique des opérations dans lesquelles ils s'engagent et ce d'autant plus que les règles communautaires ont notablement renforcé les obligations d'information à la charge des Etats membres. L'objectif de cette étude n'est pas de présenter l'état de la transposition de la directive détachement dans les différents Etats membres mais de convaincre de la nécessité d'améliorer l'information délivrée aux entreprises et aux travailleurs. L'effectivité de la règle de droit suppose en effet que les acteurs, qu'ils aient en charge l'obligation de l'appliquer ou qu'ils en soient bénéficiaires, soient en état de la connaître. ..."
