"This book gives an overall picture of the principles of Belgian industrial relations law, such as trade union freedom, the instruments for social dialogue, collective bargaining agreements and collective action.

The first edition was published almost twenty years ago. In this new edition, some topics have been omitted or shortened and others have been elaborated. For instance, we opted to discuss social dialogue in the public sector. The chapter relating to the European Works Council and the European Company, on the other hand, was drastically abridged, not only because these bodies hardly exist in Belgium, but also because the relevant legislation is a faithful copy of the European directives.

This publication is intended for all those who want to get acquainted with Belgian industrial relations and is certainly not an academic monograph. The number of footnotes is therefore very limited and - unlike in the first edition - bibliographical references were not included at the back of the chapters. However, a general bibliography is included, as well as a number of useful websites."

"Trade unions across the globe face a range of disruptions that are destabilising traditional structures, practices and strategies. This book sets out a novel approach centred on experimentation in response to these disruptions. Drawing on in-depth analysis of cases of union innovation in a broad selection of countries and industries, a stellar cast of researchers report on and draw lessons from these renewal initiatives. Aggregating these experiments enables us to identify a number of rich, cross-disciplinary findings to support such initiatives.

Initial chapters set out the approach and provide an overview of the eighteen case studies. Subsequent sections group the cases thematically: contending with neoliberalism, the fissured gig economy, value chain initiatives between South and North, an expanding trade union agenda, pursuing innovations in union repertoires and methods, and developing new forms of inclusion and solidarity. The case studies cover a wide geographical spread, from emerging economies in Africa, Asia and Latin America, to cases in Europe, North America and Australia. To ensure accessibility for both trade unionists and researchers, and to facilitate cross-case comparisons, the case studies use a common template.

The final chapter draws out practical lessons in relation to the strategic capabilities required to engage in experimentation, the diversification and enlargement of union strategic repertoires, and the conditions of success for such experimentation. These cases of experimentation indicate that the fundamentals of union purpose and the promotion of better work remain as important as ever, but they are under challenge. The lens of experimentation offers a practical approach, exploring multiple dimensions of worker and union creativity and resilience with a view to stimulating, monitoring and further developing the processes of renewal under way."

"At the core of all societies and economies are human beings deploying their energies and talents in productive activities - that is, at work. The law governing human productive activity is a large part of what determines outcomes in terms of social justice, material wellbeing, and the sustainability of both. It is hardly surprising, therefore, that work is heavily regulated.
This Handbook examines the 'law of work', a term that includes legislation setting employment standards, collective labour law, workplace discrimination law, the law regulating the contract of employment, and international labour law. It covers the regulation of relations between employer and employee, as well as labour unions, but also discussions on the contested boundaries and efforts to expand the scope of some laws regulating work beyond the traditional boundaries.
Written by a team of experts in the field of labour law, the Handbook offers a comprehensive review and analysis, both theoretical and critical. It includes 60 chapters, divided into four parts. Part A establishes the fundamentals, including the historical development of the law of work, why it is needed, the conceptual building blocks, and the unsettled boundaries. Part B considers the core concerns of the law of work, including the contract of employment doctrines, main protections in employment legislation, the regulation of collective relations, discrimination, and human rights. Part C looks at the international and transnational dimension of the law of work. The final Part examines overarching themes, including discussion of recent developments such as gig work, online work, artificial intelligence at work, sustainable development, amongst others."

"This unique book offers a comprehensive systematization and overview of the EU´s emerging ‘acquis' and practice of Collective Labour Law. Although the core aspects of Collective Labour Law lie outside the EU's competence to regulate, the laws and industrial relations systems of Member States are undoubtedly influenced by the EU, and the involvement of Social Partners, i.e. representatives of employers and workers, is essential for many aspects of EU law and policy.

Featuring contributions from scholars and practitioners from across Europe, the first part of the book provides an introduction to key aspects, theories and topics of EU Collective Labour Law, including discussion of relevant EU law and case law of the Court of Justice of the EU. Chapters then move on to analyse and reflect on the most fundamental and challenging subtopics, questions and issues in this area, engaging with current debates and potential future developments. Respecting differences in views, approaches, and evaluations, it offers a variety of perspectives on the relationship between Collective Labour Law and the EU."

Journal of European Public Policy - n° Early view -

"The revision of the Posting of Workers Directive (PWD) was welcomed as an important step towards a more Social Europe. In this article, we examine how EU member states (MS) implemented the revised directive. We focus on those parts of the directive that should enable MS to reverse previous negative integration by the European Court of Justice. Despite the initial enthusiasm, the revision has led to only minor changes in national labour law. We ask why MS that actively pushed for the revision did not exploit the new regulatory possibilities further. In addition to presenting comparative data on national implementation, we conduct in-depth case studies of countries that supported the revision at the EU level (Denmark, Finland, Germany). Disagreements between employers and trade unions, partisan effects, and institutional misfit between the PWD and national wage-settingsystems explain the limited impact of the revision in these MS. The revision of the PWD shows how difficult it is to politically counteract the market-making impetus of European single market law."

"This book gives an overall picture of the principles of Belgian labour law, i.e. employment law as well as industrial relations law. It is intended for all those who want to become acquainted with Belgian labour law including foreign law firms, entrepreneurs who want to invest in Belgium, etc. For this reason the book focuses on topics that are of practical relevance.
The authors not only describe and analyse the legal aspects of labour relations, but also indicate developing trends in Belgium. The book provides an up-to-date survey of the legislation that is both sufficiently detailed and usefully brief to answer most questions likely to arise in a legal setting.
The authors describe all important details of the law governing working hours and wages, benefits, trade union activity, employers' associations, collective bargaining, industrial disputes, and much more.
Building on a clear overview of labour law and industrial relations, the book offers practical guidance on which sound decisions in the labour law context may be based. "

"This book provides for a comprehensive overview of the various areas of European labour law: fundamental rights, free movement of workers and posting, equal treatment, a-typical forms of employment, collective bargaining and collective agreements, restructuring of enterprises and health and safety. The chapters are written by eminent experts from a considerable number of EU Member States. Most of them are written by two authors from different Member States.

As a result of this duo-authorship the book does not approach European labour law from a single country perspective, but intends to give insight in the different ways European labour was s received and implemented in the various Member States.

The book does not only describe the current state of affairs, but also critically assesses how the interaction of EU legislature, Court of Justice, Member States and social partners has contributed to the development of EU labour law. As such, it is not only a comprehensive introduction to European labour law, but provides also food for thought as part of advanced study in this area."
