The International Journal of Comparative Labour Law and Industrial Relations

"This article examines the existing quasi-legal means by which international labour standards may be protected. This article considers the nature of the challenge that global capital creates for labour, the development of the International Labour Organizations (ILO's) labour standards, and the consequences of its shift towards promotional principles, the growth of corporate voluntary initiatives by multinational corporations (MNCs), and finally the associated debates around the inclusion of social clauses in trade agreements. The analysis suggests that the ILO's shift to ‘promotional principles' and the formal acceptance of voluntary self-regulation from the late 1990s has not significantly improved the situation for workers but was a pragmatic response driven in part by US policy and the increasing marginalization of the ILO within the global system of economic governance. It is argued that even if the many political obstacles could be overcome, the result of including social clauses in World Trade Organization (WTO) trade agreements may not be straightforward. In conclusion, it is argued that in some respects the existing system has ‘privatized' labour rights."

"La décision du gouvernement britannique de sortir de l'Union européenne a remis en question l'application de la législation européenne pour les entreprises opérant au Royaume-Uni, y compris la législation régissant les comités d'entreprise européens (CEE). Ainsi, les entreprises multinationales basées au Royaume-Uni doivent transférer leur CEE dans un État membre de l'Union. En outre, les accords de CEE des entreprises multinationales opérant au Royaume-Uni peuvent être renégociés à la baisse par rapport à la représentation de ce pays. Cet article interroge l'impact du Brexit sur les CEE à travers une enquête comparative au niveau international, basée sur 64 cas d'entreprises multinationales et 16 monographies d'entreprise détaillées. Elle met la focale sur les processus de (re)négociation des accords de CEE au sein des entreprises légalement affectées par le Brexit et montre une distribution différenciée des résultats réglementaires de ces négociations selon le pays d'implantation du CEE."

"This article explores the effects of corporate organizational structure and of subsidiary discretion within multinational companies (MNCs). It draws on a representative survey of the most senior HR practitioner in foreign- and domestic-controlled subsidiaries in Canada. Key findings point to the importance of subsidiary discretion, especially discretion over human resource management. Greater subsidiary discretion is associated with a range of positive outcomes: securing international product and service mandates; greater subsidiary influence within the MNC; the promotion and protection of subsidiary employment (increased headcounts, less offshoring, more onshoring); and enhanced engagement with domestic institutions. These results highlight the strategic importance for union, civil society and public policy actors, as well as MNC subsidiary managers themselves, to focus on the drivers of subsidiary discretion, as opposed to the ‘hollowing out' of corporate structures, and to weave that discretion into larger policy narratives to promote local economies."
